Foodime is a software-as-a-service (SaaS) platform providing:
• POS software
• Self-service ordering interfaces
• AI-assisted phone order handling
Foodime is a technology provider only and does not:
• Operate restaurants
• Act as an agent for the customer
• Make business decisions on behalf of the customer
Foodime uses artificial intelligence and automated systems that are inherently probabilistic and non-deterministic.
The customer expressly acknowledges and agrees that:
• AI-generated outputs may be inaccurate, incomplete, delayed, or incorrect
• AI systems may misunderstand speech, accents, noise, intent, or context
• AI outputs must be reviewed and validated by the customer
⚠️ Foodime makes no warranties regarding AI accuracy, reliability, or suitability for any purpose.
Foodime does not guarantee:
• Order accuracy
• Increased revenue
• Reduced staffing needs
• Customer satisfaction
• Regulatory compliance of customer operations.
All business outcomes remain the sole responsibility of the customer.
The customer is solely responsible for:
• Menu accuracy, pricing, allergens, and availability
• Monitoring and validating orders
• Training staff
• Informing end customers that AI may be used
• Compliance with consumer protection, food safety, marketing, and recording laws
• Services are provided on a subscription basis
• Fees are billed monthly in advance
• Prices exclude VAT unless stated otherwise
• Subscription tiers define feature access and usage limits
• Either party may terminate with one (1) month’s written notice
• Termination takes effect at the end of the current billing period
• No refunds for unused time
Foodime may terminate immediately for breach, misuse, or non-payment.
Foodime may integrate with third-party services (POS, telecom, payment providers).
Foodime:
• Does not control third-party systems
• Disclaims all liability arising from third-party failures
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
• FOODIME SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY THE CUSTOMER IN THE PRECEDING TWELVE (12) MONTHS
The customer agrees to defend, indemnify, and hold harmless Foodime and XIIA Ventures ApS from any claims arising from:
• Restaurant operations
• AI-generated errors
• Customer complaints
• Regulatory enforcement
• Data protection violations caused by customer actions
